Justice often requires application of legal principles known as 'equity' whereas pure application of contract law or tort law doctrine fails to address concerns and thus application of the doctrine available only in these areas of law would produce an unfair result.  Accordingly, doctrine embodied as 'equitable relief' arose as a means of aiding in the effort to ensure that application of law in certain circumstances would produce a morally 'fair' result.

Major miscarriages of justice have occurred because of the absence of proper legal representation.
